Privacy Policy

Butter Pty Ltd (“Butter”, “we”, “our”, “us”) is committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This Privacy Policy explains how we collect, use, store, disclose and protect your personal information when you use our website, app and services (together, the Application).

What information we collect 

Personal Information means information that identifies you as an individual. The types of personal information we may collect include:

  • Name, age, and contact details (email, phone, suburb)

  • Account login details (username, password)

  • Social interests and demographic information (for club/event matching)

  • Payment-related information (processed via Stripe; Butter Pty Ltd does not store your full card details)

  • Communications you send to us (support requests, feedback, correspondence)

  • Usage data from your interaction with the Application (plans joined, events attended, preferences)

We may also collect Sensitive Information (as defined by the Privacy Act), such as information about your social interests, wellbeing, or community group participation. We will only collect and use such information with your consent or where otherwise authorised by law.

How we collect it 

We collect personal information directly from you when you:

  • Register an account on the Application 

  • Join a club or attend an event

  • Purchase a ticket or send peer-to-peer payments

  • Communicate with us via email, phone, or in-app messaging

  • Interact with our website, app, or marketing materials

 

We may also collect information from third parties (such as Stripe or other service providers), publicly available sources, or cookies and tracking technologies on our website/Application.

How we use it 

We collect and use your personal information for purposes including to:

  • Provide and operate the Application and services

  • Process payments, ticketing, and peer-to-peer payments via our third-party payment processor (Stripe)

  • Facilitate your participation in clubs, plans, and events

  • Communicate with you about your account, plans, and events (transactional notices)

  • Send you marketing communications where you have not opted out

  • Improve the Application, analyse usage trends, and run advertising campaigns

  • Comply with legal obligations

 

You may opt out of marketing communications at any time. You will still receive transactional messages necessary to use the Application (e.g. plan reminders, payment confirmations).

Sharing your information 

We may disclose your personal information in the following ways:

1. With Hosts of Clubs

When you join a club or attend a Club event, we share your name and email with the relevant Host. This allows the Host to manage attendance and communicate with Members.

Hosts may only use your personal information for these purposes while they are active on Butter. A Host may send you external marketing communications only if you have expressly opted in to receive them upon joining the club, or you have purchased a ticket from the Club.

If a Host and their Club leaves Butter, they may only retain and use the details of Members who have opted in to their external marketing communications or have purchased a ticket from the Club. All other Member information must be deleted and cannot be exported, retained, or otherwise used outside the Butter platform.

We require Hosts to comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and this Privacy Policy when handling your personal information.

2. With Service Providers

We use Stripe to process all payments. Stripe may collect and store your payment information in accordance with its own Privacy Policy. Butter Pty Ltd does not store your full payment card details. We may also share information with other providers such as analytics, and customer support tools.

 

3. Legal Obligations

Where required or authorised by law, or to enforce our rights under our Terms of Service.

 

Some of our service providers may store or access personal information outside Australia, including in the United States. By using our services, you consent to this overseas disclosure.

Data retention

We retain your personal information only for as long as necessary for the purposes set out in this Policy or as required by law. For example:

  • Payment and transaction records are kept for at least 7 years to comply with legal and tax obligations.

  • Account and club participation data are kept while your account is active.

  • Marketing data is deleted when you unsubscribe or delete your account.

 

You may request deletion of your account and associated personal information at any time (subject to our need to retain certain records for legal compliance).

Security of your information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access and correction 

You may access or update the personal information we hold about you at any time by contacting us in writing. We may require identification before releasing requested information.

If you believe any information we hold about you is inaccurate, incomplete, or out of date, please let us know and we will correct it.

Your rights 

Under the Privacy Act, you have the right to:

  • Access and correct your personal information

  • Request deletion of your account and associated data

  • Opt out of direct marketing communications

  • Make a complaint if you believe we have breached the APPs


If you are not satisfied with our response to a privacy complaint, you may refer the matter to the Office of the Australian Information Commissioner (www.oaic.gov.au).

Cookies and tracking 

Our website and Application may use cookies, analytics tools, and advertising pixels to improve your experience and deliver targeted advertising. You can manage or disable cookies through your browser settings, but this may affect your use of the Application.

Policy updates

We may update this Privacy Policy from time to time. The updated version will be published on our website with the effective date. We encourage you to review the Policy periodically.
